It's Lawsuit Time
I'm preparing all of the paperwork for suing my ex- landlord slumlord. He has not returned my deposit, and continues to insist we broke the lease and that there's some sort of "final accounting" he needs to do. So, it's time to give a judge the opportunity to crack his head in.
I'd like to get everyone that helped with each of our moves to write up a summary of which dates you were at the house, and what condition the house was in. Please give details on the condition of the whole house, and if you can, speak about your experiences with the contested areas of the house. I'm fairly certain it'll come up during the hearing.
The specifically contested areas of the house are:
1. The front screen door that was on the sun porch. The slumlord is claiming it was damaged and needed to be rehung. My claim is that it was in good working condition when I left.
2. The carpet on the stairs leading down to the basement. The slumlord is claiming they were dirty and required professional cleaning. My claim is that due to the flood damage, and subsequent work done in the basement, the carpet was as clean as could be expected and is not my responsibility, as it's a part of the basement and was subjected to the same basic conditions as the rest of the flooded basement.
3. The general condition and cleanliness of the house. The slumlord is claiming that because there was an accumulation of dirt underneath the oven and refridgerator, along with a thin layer of dust on the window sills, this required the services of a professional cleaner. My claim is that none of this is exceptional filth, and all of it is normal wear and tear, which isn't my responsibility.
4. The drawers beneath the bathroom sink were damaged. During the walkthrough, the slumlord pulled the face off of one of the drawers as he was "checking" it. His claim is that this was damaged during my tenancy. My claim is that throughout my short tenancy, it was just fine and was broken after I had vacated, so the cost of the repairs aren't my responsibility.
I will also need each statement to be notarized.
